Information We Collect

We may obtain information, including Personal Information, from various sources, including the Online Services, when you call or email us or communicate with us through social media, or from our business partners and other third parties. The types of Personal Information we may collect about you when you visit the Online Services may include:

• Your contact information (such as name, email address)
• Username and password for the account you may establish on our Online Services
• Records of visits to participating merchant websites
• Records of your purchases and other transactions on or through the Online Services or through participating merchants
• Information you provide by interacting with us through social media, including information from your public profile

In addition, when you use our Online Services, we may collect certain information, including Personal Information, by automated means, such as cookies and web beacons. The “Information We Share” section below describes how ShopRaise may share your Personal Information. We may, but are not obligated to, also use the information, including Personal Information, we obtain about you to:

• create and manage online accounts and profiles that you may establish on our Online Services,
• provide products or services you request,
• process, validate, confirm, verify, deliver, and track your purchase of any gift card or any donation you may make through the Online Services (including by processing payment card transactions, arranging shipping and handling returns and refunds, and contacting you about your order of any gift card, including by telephone),respond to your questions and comments and provide customer support,
• communicate with you about our products, services, offers, events and promotions,
• enable you to communicate with us through our blogs, social networks and other interactive media,
• analyze trends and statistics regarding visitors’ use of the Online Services, mobile applications and social media assets, and the purchases visitors make on our Online Services so that we may tailor our Online Services to better meet your needs,
• monitor for fraud, unauthorized transactions, claims and other liabilities, including by identifying potential hackers and other unauthorized users, and
• enforce our Terms of Service and comply with applicable legal requirements and industry standards.

In addition to the uses described above, we may use the information, including Personal Information, collected through cookies, web beacons, and other automated means to identify and authenticate visitors, administer the Online Services, and gather broad demographic information in order to analyze patterns in the use of the Online Services.

We also may use the information, including Personal Information, we obtain about you in other ways for which we provide specific notice at the time of collection.

How to Request Deletion of Data

UNLESS YOU REQUEST THAT WE DELETE CERTAIN INFORMATION, INCLUDING PERSONAL INFORMATION, IN ACCORDANCE WITH THIS PRIVACY POLICY, WE RETAIN SUCH INFORMATION FOR AS LONG AS NEEDED FOR OUR BUSINESS AND LEGAL PURPOSES. IN ADDITION, EVEN IF YOU REQUEST SUCH DELETION, IN CERTAIN CIRCUMSTANCES, WE MAY BE REQUIRED TO RETAIN INFORMATION, INCLUDING PERSONAL INFORMATION TO COMPLY WITH APPLICABLE LAWS AND REGULATIONS.

To request deletion of data please submit a request in the ShopRaise help section with the subject of Deletion Request. To verify your identity, we may ask you for additional information, which may include asking you to confirm other Personal Information you have provided to us. We reserve the right to deny any requests for which identity cannot be verified

Information we share

We do not sell or otherwise disclose personal information about you, except as described in this Privacy Policy. We share personal information about you with third parties to perform services on our behalf in order to complete services or transactions you request or submit through our Online Services. We do not authorize our service providers or other third parties with whom we share personal information to use or disclose the information for any purpose other than the purposes for which we provide the information, as described above and below, or to comply with legal requirements. We may also disclose aggregate information compiled using your personal information that does not identify particular users. This may include, for example, the total number of visitors to the Online Services from a particular part of the country.

In order to make donations to your chosen cause, we share personal information about you with the cause(s) that you choose to support. If you do not want your information shared with your chosen cause(s) you are barred from using our services.

We may also disclose information about you (i) if we are required to do so by law or legal process, (ii) to law enforcement authorities or other government officials, or (iii) when we believe disclosure is necessary or appropriate to prevent physical harm or financial loss, or in connection with an investigation of suspected or actual fraudulent or illegal activity.

We may sell, transfer, or otherwise share some or all of our assets, including your Personal Information, in connection with a merger, acquisition, reorganization or sale of assets (including, in each case, as part of the due-diligence process with any potential acquiring or merging entity) or in the event of bankruptcy. You will be notified via email and/or a prominent notice on our website of any material change in ownership or uses of your Personal Information, as well as any choices you may have regarding your Personal Information.

Access and Correction

You may obtain a copy of certain Personal Information we maintain about you or update or correct inaccuracies in that Personal Information using the account you may establish on the Online Services. In addition, if you believe other Personal Information we maintain about you is inaccurate, you may request that we correct or amend the information by contacting us by emailing INFO@ShopRaise.com. If we deny an access request, we will notify you of the reasons for the denial.

Children's Privacy

The Fundraising Portal encourages protection of children’s information on the Internet. The Online Services is not intended for and may not be used by children under the age of 13. We do not knowingly collect information from children under the age of 13 and we do not target the Online Services to children under the age of 13.

Affiliate Tracking

We partner with Rakuten Advertising, who may collect personal information when you interact with our site. The collection and use of this information is subject to the privacy policy located here:

Changes To Our Policy

We encourage protection of children’s information on the Internet. The Online Services are not intended for and may not be used by children under the age of 13. We do not knowingly collect information from children under the age of 13 and we do not target the Online Services to children under the age of 13.

Additional Privacy Rights Under the CCPA

The California Consumer Privacy Act of 2018 (Cal. Civ. Code § 1798.100 to 1798.199), as amended (“CCPA”), requires that we describe how we collect, process, and share your Personal Information regarding California residents (as defined under California law).

During the past twelve (12) months, we have collected, used, and shared the following categories of Personal Information:

If you are a resident of California, you have the right to request that we disclose certain information to you about our collection and use of your Personal Information over the past 12 months (“Right to Know”). Once we receive and confirm your verifiable request, we will disclose to you:

• the categories of Personal Information we collected about you,
• the categories of sources for the Personal Information we collected about you,
• our commercial purpose for collecting or selling that Personal Information,
• the categories of third parties with whom we share that Personal Information,
• the specific pieces of Personal Information we collected about you, and
• if we sold or disclosed your Personal Information for a business purpose, two separate lists disclosing: (i) sales, identifying the Personal Information categories that each category of recipient purchased; and (ii) disclosures for a business purpose, identifying the Personal Information categories that each category of recipient obtained.

All users of our Online Services have the right to request that we delete any of your Personal Information that we collected from you and retained, subject to certain exceptions available to us through CCPA (“Right to Delete”). Once we receive and confirm your verifiable request, we will delete (and direct our service providers to delete) your Personal Information from our records, unless an exception available to us through CCPA applies. If so, we will notify you in our response than an exception applies and identify that exception.

To exercise the Right to Know or Right to Delete, please submit a request to us by submitting a request in the ShopRaise help section. To verify your identity we may ask you for additional information, which may include asking you to confirm other Personal Information you have provided to us. We reserve the right to deny any requests for which identity cannot be verified. If you have authorized another person to make a request on your behalf, that person must provide to us your written authorization allowing them to make such a request on your behalf. We reserve the right to deny any request by an authorized agent if we are not reasonably able to confirm proper authorization.

If a business sells consumer Personal Information, the CCPA grants residents of California a right to tell a business not to sell (i.e., opt out of the sale of) their Personal Information. We do not sell your Personal Information.

We will not discriminate against you for exercising any of your rights under California law. Unless permitted by California law, we will not:

• deny you services,
• charge you a different price or rates for services, including through granting discounts or other benefits, or imposing penalties,
• provide you a different level or quality of services, or
• suggest that you may receive a different price or rate for services or a different level or quality of services.

Pursuant to California Civil Code Section 1798.83, California residents who provide us with Personal Information in using the Online Services are entitled to request and obtain from us, once per calendar year, information about the Personal Information we shared, if any, with other businesses for their own direct marketing uses.

We are not responsible for notices that are not labeled or sent properly, or do not include complete information.

European Residents – Your EU Specific Terms

To comply with the requirements of the European General Data Protection Regulation (the “GDPR”) for our European users, this Privacy Policy outlines the legal basis on which we process your Personal Information and provide other information required by the GDPR. The terms and conditions contained in this section applies only to the Personal Information of European Union residents we may process.

Legal Basis for Processing Your Personal Information

If you are a resident of the European Union, we will only process your Personal Information where we have a legal basis to do so. The legal basis will depend on the reason(s) we collected and need to use your Personal Information. The different legal bases we rely on are as follows:

If you are a resident of the European Union, where the processing of your Personal Information by us is based on consent, you have the right to withdraw that consent without detriment at any time by emailing in the ShopRaise help section. Such withdrawal will not affect the processing of your Personal Information prior to the withdrawal.

Changes To Our Policy

This Privacy Policy may be updated periodically and without prior notice to you to reflect changes in our information practices. We will post a prominent notice on the Online Services or send you an e-mail to notify you of any material changes to our Privacy Policy and we will indicate at the top of the policy when it was most recently updated.
